Under Florida Chapter 765, the statute governing health care advance directives, it’s a written declaration specifying which life-prolonging procedures you do or don’t want if two physicians certify in writing that you have a terminal condition, an end-stage condition, or are in a persistent vegetative state. Until that threshold is reached, the document has no operative effect. And it can only be created while you’re legally competent. Once incapacity occurs, the window closes.

Florida Law on Living Wills & Advance Directives

Florida Chapter 765 governs health care advance directives. Understanding its requirements can help ensure any document you sign is properly executed and available when it matters most.

Execution Requirements

A Florida living will must be signed by the maker in the presence of two adult witnesses, and at least one of those witnesses can’t be a spouse or blood relative of the maker. Florida doesn’t require notarization, which distinguishes living wills from most other Florida estate documents, such as wills and durable powers of attorney.

Triggering Conditions

The document takes effect only after two physicians certify in writing that the maker has a terminal condition, an end-stage condition, or is in a persistent vegetative state and that no medical treatment can restore a meaningful quality of life. Under Florida Chapter 765, life-prolonging procedures include artificially provided sustenance and hydration. This means a living will can address decisions about food and water alongside other medical interventions.

What the Document Can Address

A living will can specify preferences about a range of interventions:

Artificial nutrition and hydration
Mechanical ventilation
Dialysis and CPR
Palliative or hospice care and pain-management medications
Other life-prolonging treatments

Organ and tissue donation preferences can be included within the living will or recorded separately through an anatomical gift designation under Chapter 765 Part V.

Revocation & Out-of-State Recognition

A living will can be revoked at any time, regardless of the maker’s current physical or mental condition, through a written statement, physical destruction of the document, an oral statement, or a new directive. Florida will also recognize a living will signed in another state if it was executed in compliance with that state’s laws or with Florida’s.

The Full Advance Directive Package

A living will addresses end-of-life medical preferences, but it doesn’t cover every situation where you might be unable to make decisions for yourself. That’s why I draft living wills alongside the companion documents that complete the picture.

Health Care Surrogate Designation

A designation of health care surrogate names a trusted person to make medical decisions any time you can’t give informed consent. That scope is broader than a living will, which is limited to end-of-life situations. The two documents work together rather than duplicating each other. Naming a surrogate may also help your family avoid formal guardianship proceedings, which can be costly and time-consuming.

One important point under Florida law: divorce or annulment automatically revokes a former spouse’s designation as health care surrogate unless the directive specifically states otherwise. Major life events are a good reason to revisit these documents.

Durable Power of Attorney

A durable power of attorney for finances designates someone to manage your financial affairs if you become unable to do so. It covers bill payment, account management, and financial transactions. It operates independently from your health care documents and handles the financial side of incapacity that a living will or surrogate designation doesn’t address.

Together, these three documents form a coordinated incapacity plan. I draft all of them and walk clients through how they work together.
