The Probate Process in Alachua County

Probate cases in Gainesville are filed with the Alachua County Clerk of Court at the Alachua County Courthouse in downtown Gainesville. I handle all required filings and guide clients through each stage so that deadlines and procedural requirements don’t get missed. The process generally follows this sequence, though timelines vary depending on the complexity of the estate and the circumstances involved.

Filing Through Distribution

Filing the Petition
The process begins with filing a Petition for Administration with the circuit court, along with the original will if one exists. The court reviews the petition and, in a formal administration, appoints the personal representative.

Notice to Creditors
The personal representative publishes a Notice to Creditors, which opens a period during which creditors may file claims against the estate. Valid debts, expenses, and taxes are paid from estate assets before any distributions to beneficiaries.

Asset Inventory and Distribution
Estate assets are identified, secured, and inventoried. Once all obligations are resolved, remaining assets are distributed to beneficiaries in accordance with the will or, when no valid will exists, under Florida’s intestate succession laws.

Order of Discharge
After distributions are complete and all court requirements are satisfied, the court issues a final Order of Discharge, formally closing the estate. In many Florida probate matters, neither the attorney nor the client is required to appear in person, as many filings and proceedings are handled electronically or by telephone.

When a plan wasn’t in place or is outdated, the estate can still be administered under Florida law.
