Florida’s Two Types of Probate Administration

Florida law provides two primary forms of probate, and the right one depends on the size and structure of the estate. Understanding the difference helps you know what to expect before we speak.

Summary Administration

Summary Administration is a simplified, expedited process available for qualifying estates. It may be used when the estate’s non-exempt assets fall below the threshold set by Florida law, or when the decedent has been deceased for more than two years. The process involves fewer court filings than formal administration, making it appropriate when the estate meets the eligibility requirements.

Formal Administration

Formal Administration is the standard process for larger or more complex estates. The court appoints a personal representative, who is then authorized to locate assets, notify creditors, satisfy debts, and distribute what remains to beneficiaries. Florida law generally requires the personal representative in a formal administration to retain a licensed attorney throughout the process.

One point that surprises many families: a will doesn’t automatically avoid probate. Assets titled solely in the decedent’s name without a named beneficiary typically must pass through probate whether or not a will exists. The appropriate administration type depends on the estate’s total value, its asset structure, and the specific circumstances at the time of death.

What Passes Through Probate & What Doesn’t

Not every asset in an estate goes through probate court. Understanding which assets do and which don’t helps clarify what administration will actually involve.

Assets that typically bypass probate:

Life insurance policies and retirement accounts with named beneficiaries pass directly to those beneficiaries
Property held in a revocable living trust passes according to the trust terms
Assets held in joint tenancy with right of survivorship transfer automatically to the surviving owner

Assets that typically require probate:

Property titled solely in the decedent’s name with no designated beneficiary
Bank or investment accounts without a payable-on-death or transfer-on-death designation

The Probate Process in Alachua County

Probate cases in Gainesville are filed with the Alachua County Clerk of Court at the Alachua County Courthouse in downtown Gainesville. I handle all required filings and guide clients through each stage so that deadlines and procedural requirements don’t get missed. The process generally follows this sequence, though timelines vary depending on the complexity of the estate and the circumstances involved.

Filing Through Distribution

Filing the Petition
The process begins with filing a Petition for Administration with the circuit court, along with the original will if one exists. The court reviews the petition and, in a formal administration, appoints the personal representative.

Notice to Creditors
The personal representative publishes a Notice to Creditors, which opens a period during which creditors may file claims against the estate. Valid debts, expenses, and taxes are paid from estate assets before any distributions to beneficiaries.

Asset Inventory and Distribution
Estate assets are identified, secured, and inventoried. Once all obligations are resolved, remaining assets are distributed to beneficiaries in accordance with the will or, when no valid will exists, under Florida’s intestate succession laws.

Order of Discharge
After distributions are complete and all court requirements are satisfied, the court issues a final Order of Discharge, formally closing the estate. In many Florida probate matters, neither the attorney nor the client is required to appear in person, as many filings and proceedings are handled electronically or by telephone.

When I know the decedent’s asset structure and the intent behind an estate plan, administration can move more efficiently because there are fewer unknowns to uncover along the way. When a plan wasn’t in place or is outdated, the estate can still be administered under Florida law.

During planning, I work with clients on trusts, transfer-on-death designations, and beneficiary designations that can reduce the assets that must pass through probate, which can simplify the process for heirs. Working with one attorney across both stages means you don’t need to bring someone new up to speed at an already difficult time.

The Personal Representative’s Role and Responsibilities

The personal representative, sometimes called the executor, is the individual appointed by the court to manage and close the estate. It’s a position that carries real legal obligations, and I work closely with personal representatives throughout the administration to help them meet those obligations correctly.

Core duties of the personal representative include:

Locating and securing estate assets
Publishing the Notice to Creditors and managing creditor claims
Paying valid debts, expenses, and taxes from estate funds
Filing all required court documents within applicable deadlines
Distributing remaining assets to beneficiaries once obligations are resolved

A personal representative can be held personally liable to beneficiaries for failing to meet these obligations. Common errors include missing creditor notice deadlines, failing to properly inventory assets, and making distributions before debts are fully resolved. Florida law generally requires personal representatives in formal administration to retain a licensed attorney, so you won’t be navigating this alone.
