Estate litigation in Florida is governed primarily by the Florida Probate Code, Chapters 731 through 735 of the Florida Statutes. Trust disputes fall under the Florida Trust Code, Chapter 736. These statutes define the duties of personal representatives and trustees, the grounds for removal, and the procedures for challenging a will or trust in circuit court.

Undue Influence, Deadlines, & Where to File

Florida courts apply a presumption of undue influence when a substantial beneficiary was active in procuring the will or trust and held a confidential relationship with the decedent. That presumption shifts the burden to the beneficiary to rebut the inference of improper conduct. In Gainesville, contested estate matters are filed in the probate division at the Alachua County Courthouse. Deadlines are strict: Florida law imposes specific time limits to object to a personal representative’s actions and to contest a will after letters of administration are issued. Missing those windows can affect your rights.

Trustee Duties & Removal

Trustees in Florida owe duties of loyalty, impartiality, and prudent administration. Under the Florida Trust Code, a court may remove a trustee for a serious breach of trust, persistent failure to administer the trust effectively, or other grounds set out in Chapter 736, and may surcharge them for losses caused to the estate.

What to Expect During Estate Litigation

Not every estate dispute ends in a courtroom. Many are resolved through negotiation or court-ordered mediation, and Florida courts often require mediation before a matter proceeds to an evidentiary hearing. Some disputes do require a judge to decide, and in Florida, contested probate and trust matters are decided by a judge, not a jury.

If litigation proceeds, discovery typically includes depositions of witnesses to the will, financial records, medical records establishing the decedent’s capacity, and communications between the drafting attorney and the decedent. The party challenging a will or trust bears the burden of producing evidence sufficient to overcome the legal presumption of its validity. Attorney fees may be assessed against the estate or a party depending on the outcome and the conduct of the parties.
